1. Acceptance

By using Yawmak you agree to these terms. If you do not agree, do not use the service.

2. What Yawmak Is

Yawmak is a B2B SaaS platform that automates birthday cake delivery for companies. We connect companies with local bakery partners in Lebanon.

3. Company Responsibilities

• You are responsible for the accuracy of employee data you upload
• You must have legal authority to upload employee personal data (names, birthdays) — obtain consent from your employees if required by your local laws
• You must maintain a valid payment method on file
• You must keep your login credentials secure

4. Bakery Partner Responsibilities

• Bakeries are responsible for the quality and timely delivery of their products
• Yawmak is not liable for late, incorrect, or undelivered orders by bakery partners
• Bakeries must maintain accurate catalogs and capacity settings

5. Payments and Billing

• Companies are charged monthly on the 1st of each month for that month's expected birthdays
• First month is prorated from signup date
• Refunds follow the cancellation policy set by each bakery partner
• Yawmak takes a 15% platform fee on each cake order. Bakeries receive 85%.
• Delivery fees go 100% to bakeries with no platform cut

6. Cancellations and Refunds

• Cancellations before the bakery's cutoff window: full refund
• Cancellations after cutoff: refund percentage set by bakery (0–100%)
• Refunds issued to original payment method or as account credit

7. Limitation of Liability

Yawmak is not liable for:

• Allergic reactions from cake consumption — dietary information is provided by the company; verify with your bakery
• Late or missed deliveries by bakeries
• Data loss due to circumstances beyond our reasonable control
• Any indirect or consequential damages

Our maximum liability is limited to the amount you have paid Yawmak in the last 30 days.

8. Acceptable Use

You may not:

• Upload false or fabricated employee data
• Use the platform for any unlawful purpose
• Attempt to access other companies' data
• Reverse engineer the platform
• Resell access to the platform

9. Termination

Either party may terminate at any time. Upon termination, your data is retained for 30 days then deleted upon request. Outstanding invoices remain payable.

10. Governing Law

These terms are governed by the laws of Lebanon. Disputes shall be resolved in Lebanese courts of competent jurisdiction.
